Terms of Service

These terms govern your use of XSPLASH, a non-custodial app for sending SOL or USDC to anyone on X (Twitter) using just their @handle. By accessing or using XSPLASH, you agree to be bound by these terms.
01 Acceptance of terms
By accessing or using XSPLASH (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
We reserve the right to modify these Terms at any time. Continued use of the Service following notice of any changes constitutes your acceptance of the updated Terms.
02 The Service
XSPLASH is a non-custodial application that lets you send SOL or USDC to anyone on X (Twitter) using only their @handle. It works as follows:
- You connect a Solana wallet (such as Phantom, Solflare, or Backpack via WalletConnect), choose a recipient by @handle, and pick an amount in SOL or USDC.
- The funds are locked in an on-chain Escrow smart contract on Solana. XSPLASH never holds or controls the funds.
- The recipient claims the payment by signing in with X (OAuth). If they have no wallet, one is created for them, and they pay no network gas to claim (it is sponsored).
- You may cancel and receive a full refund at any time before the recipient claims.
XSPLASH is software that helps you interact with the Solana blockchain. It is not a bank, money transmitter, custodian, exchange, or broker, and it does not offer financial, investment, or legal advice.
03 Eligibility
You must be at least the age of majority in your jurisdiction (and at least 18) to use the Service. You represent that your use of the Service is legal where you live and that you are not located in, or a resident of, any jurisdiction subject to comprehensive sanctions, and that you are not on any applicable sanctions or restricted-persons list.
04 Your wallet and responsibilities
You are solely responsible for your wallet, your private keys, and your seed phrase. XSPLASH never receives or stores them and cannot recover them if lost.
- You are responsible for verifying that the @handle you enter belongs to the intended recipient before sending.
- You are responsible for the amount and asset (SOL or USDC) you choose to send.
- You are responsible for keeping your wallet and any wallet created for you secure.
- You are responsible for all activity conducted through your connected wallet.
05 Non-custodial disclaimer
XSPLASH is fully non-custodial. We never take custody of, hold, control, or have access to your funds or your private keys. Funds move only between your wallet and the on-chain Escrow smart contract, governed by code on the Solana blockchain.
Notice: Once a recipient successfully claims a payment from Escrow, the transfer is final and irreversible. XSPLASH cannot reverse, cancel, or refund a claimed payment. You may only cancel for a refund before the recipient claims.
06 Fees
XSPLASH does not charge a platform fee to send or claim a payment.
- We sponsor the Solana network gas required for a recipient to claim, so receivers pay no gas to claim.
- Other on-chain actions (such as depositing funds into Escrow or cancelling for a refund) may incur standard Solana network gas fees, which are paid to the network, not to XSPLASH.
We may introduce or change fees in the future; any such change will be disclosed before it applies.
07 Risks
Using crypto and the Solana blockchain involves risk. By using the Service you acknowledge and accept, among others:
- Volatility. The value of SOL and USDC can change, and digital assets may lose value.
- Irreversibility. Once a payment is claimed, it cannot be reversed or refunded.
- Wrong handle. If you send to the wrong @handle, the intended person may not receive the funds; verify handles carefully before sending.
- Smart-contract risk. The Escrow smart contract, like all software, may contain bugs or be subject to exploits despite our efforts.
- Network risk. The Solana network may experience congestion, downtime, forks, or other conditions outside our control.
- Regulatory risk. Laws affecting crypto may change and could impact your ability to use the Service.
08 Prohibited uses
You may not use the Service to:
- Engage in any illegal activity or facilitate any transaction that is unlawful in your jurisdiction;
- Launder money, finance terrorism, or evade sanctions or anti-money-laundering (AML) controls;
- Send or receive funds on behalf of, or to, any sanctioned or restricted person or jurisdiction;
- Defraud, deceive, or misappropriate funds from any person;
- Facilitate spam, phishing, social engineering, or other deceptive practices;
- Interfere with, exploit, or attempt to compromise the Escrow smart contract or the Service;
- Use the Service in any way that causes or may cause harm to any individual, entity, or the Service itself.
XSPLASH reserves the right to restrict access for any use we determine, in our sole discretion, to violate this section or the spirit of these Terms.
09 Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XSPLASH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement;
- Any warranty that the Service or the Escrow smart contract will be uninterrupted, error-free, secure, or free of harmful components;
- Any warranty regarding the Solana network, wallet providers, or X sign-in;
- Any warranty that a payment will be delivered, claimed, or claimable by the intended recipient.
You assume all risk associated with your use of the Service and with sending crypto on a public blockchain.
10 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XSPLASH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages;
- Loss of funds, profits, data, goodwill, or business opportunities;
- Any loss arising from a payment sent to the wrong @handle or an irreversible claimed payment;
- Any loss arising from smart-contract bugs, exploits, or the acts or omissions of the Solana network, wallet providers, or X;
- Any loss arising from your failure to secure your wallet, private keys, or seed phrase.
Because XSPLASH is non-custodial and takes no fee for basic transfers, to the fullest extent permitted by law our aggregate liability to you for any claim relating to the Service shall not exceed one hundred U.S. dollars (USD 100).
11 Indemnification
You agree to indemnify, defend, and hold harmless XSPLASH and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service, including any payment you send, claim, or cancel;
- Your violation of these Terms;
- Your violation of any applicable law or regulation, including AML or sanctions laws;
- Any claim by a third party relating to your transactions through the Service.
12 Taxes
You are solely responsible for determining and paying any taxes that apply to your use of the Service, including any taxes arising from sending or receiving SOL or USDC. XSPLASH does not provide tax advice and does not withhold or report taxes on your behalf.
13 Changes and governing law
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, provide additional notice through the Service. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the jurisdiction in which the XSPLASH operators are established, without regard to conflict-of-law principles, except where mandatory local law provides otherwise. Nothing in these Terms limits your rights under mandatory consumer protection laws applicable in your jurisdiction.
